Terms and Conditions of Sale

These are the Terms and Conditions of Sale printed on every ZIA invoice. ZIA is a brand of Londe's Kalyani Silver Jewellery Private Limited, CIN U32111MH2021PTC366569, registered office Modi No 2, Sitabuldi, Nagpur 440012. For the exchange process in plain language, see our Exchange Policy.

In these terms, ZIA means Londe's Kalyani Silver Jewellery Private Limited, the company that owns and operates the ZIA brand. These terms are displayed at every ZIA showroom and printed on this invoice, and every sale is made on these terms.

1. Price. Every article is sold per piece at the MRP stated, inclusive of all taxes, for its design. Articles are not sold, priced or valued by weight, silver content or purity.

2. One offer per invoice. Only one discount, offer or promotional benefit applies to an invoice. Offers are not combined.

3. Invoice. ZIA recognises only its computer generated tax invoice. Every exchange, service and claim requires the original invoice and is available to its holder, and proof of ownership may be required. Jewellery not sold by ZIA is not accepted for exchange or any service.

4. Billing errors. Where an invoice states a wrong price, discount, tax or total, ZIA issues a corrected invoice. Any amount underpaid is payable by the customer and any amount overpaid is adjusted by ZIA.

5. Material. Articles are made of 925 sterling silver alloy and also contain plating, anti tarnish coating, solder, stones, beads and findings, so the purity of a finished article as a whole differs from that of the alloy. A test on a finished article is not a measure of the alloy. No purity of the finished article by weight, and no purity mark, stamp or certification, is represented.

6. Gold coloured finish. Articles described as gold polish or gold coloured are 925 sterling silver with gold coloured plating. They are not gold and carry no gold value.

7. Not defects. None of the following is a defect: tarnishing of silver; wear of plating or coating; variation in colour, texture, finish, size or weight of a handmade piece, including from photographs, catalogues and display pieces; skin reaction to metal, plating or coating; and breakage, stone loss, wear and tear, exposure to perfume, water, sweat or chemicals, or improper storage after purchase.

8. Inspection and defects. The customer inspects each article for design, size, finish and visible defects before billing, and risk of loss, theft or damage passes to the customer on handover. A visible defect must be reported within 7 days of the invoice date. A manufacturing defect is remedied by repair or, where repair is not possible, by replacement with an article of the same value, at the option of ZIA.

9. Exchange. An article may be exchanged within 7 days of the invoice date, at either ZIA showroom, for an article of equal or higher value, where it is unworn, undamaged and unaltered and is returned with its original packaging and tags. The exchange value is the price actually paid as stated on the invoice, not the MRP, and any difference is payable by the customer.

10. Not exchangeable. Engraved, customised, name or personalised articles, articles bought on clearance, sale or special offer, and articles already received in exchange are not exchangeable. Where any condition of clause 9 is not met, the exchange is declined and the reason is stated to the customer.

11. No refund and no buyback. ZIA does not refund money on any article at any time, including within the 7 day exchange period, and does not buy back any article, including articles sold by ZIA. No cashback or return for money is given. The only remedies on a purchase are the exchange under clause 9 and the repair or replacement of a manufacturing defect under clause 8. This clause applies except where refund is required by law.

12. Free services. Free repair and polish is offered on articles sold by ZIA, and free resizing within 30 days of the invoice date where the design allows. These services cover labour only. Any replacement part, stone, chain, clasp or other material is charged, and the charge is told to the customer before the work is done.

13. Only what can be done. A service is offered only where, in the judgement of ZIA, the article can be repaired, polished or resized. Some articles cannot be restored, including a chain with broken or missing links, a crushed or deformed piece, a piece missing stones or parts no longer available, and a plated or coated finish that cannot be matched. Where ZIA declines, the article is returned as received and no replacement or compensation is due.

14. Effect of service. Repair may leave a visible joint, and polishing removes a fine surface layer that may change the finish or slightly reduce weight. This is inherent to the process, is not damage, and a service does not restore an article to new condition.

15. Service receipt. Every article accepted for service is recorded on a service receipt with its description and weight, signed by the customer, and the receipt is required to collect it. Service may take up to 60 days.

16. Uncollected articles. An article not collected within 90 days of intimation is at the risk of the customer, and one not collected within 6 months may be disposed of by ZIA after 30 days notice to the phone number on the service receipt.

17. Limit of liability. The liability of ZIA on any claim, including for an article in its custody, does not exceed the price paid for that article as stated on the invoice. ZIA is not liable for indirect or consequential loss.

18. Only written terms apply. These terms, the invoice and the policies published by ZIA are the only terms of sale. No promise or statement by any staff member or other person, spoken, by phone or by message, binds ZIA unless written on the invoice. Staff cannot vary these terms, and a concession given to one customer is for that occasion only and creates no right for anyone else.

19. Amendment. ZIA may amend these terms for future purchases, and the terms printed on the invoice govern that purchase. If any term is held unenforceable, the rest continue in force.

20. Complaints and disputes. Complaints may be sent to help@ziasilverjewellery.com or raised at either ZIA showroom. Disputes are subject to the courts at Nagpur, Maharashtra, without affecting the right of a consumer to approach the Consumer Commission having jurisdiction under the Consumer Protection Act, 2019.
